<br />Agreement shall be [six (6) months] unless terminated sooner pursuant to Article 8 herein <br />or extended by Change Order pursuant to Article 1.5 herein. <br />2.2 If Contractor is delayed at any time in the progress of the Work by Change <br />Order(s), by labor disputes, fire, unusual delay in transportation, adverse weather conditions <br />not reasonably anticipated, unavoidable casualties, or any other causes or acts of nature <br />beyond Contractor's control and without the fault or negligence of Contractor, Contractor <br />shall prepare and submit to DMG and BMRI within ten (10) calendar days of the <br />occurrence a written report of its assessment of the occurrence and any proposed <br />amendment to the Term. Contractor shall proceed with due diligence to alleviate any such <br />delay and shall continue in the performance of its obligations hereunder. DMG in consulta- <br />lion with BMRI may determine after the receipt of such notice of delay from Contractor, <br />whether to terminate this Agreement in accordance with Article 8 hereof or extend the <br />Term by Change Order for such time as both DMG and BMRI may determine. <br />Article 3 -Compensation and Method of Payment <br />3.1 BMRI shall pay Contractor on a time and materials basis for completion of <br />the Work set forth in the Scope of Work (Exhibit A) attached hereto. In no event shall the <br />amount payable hereunder exceed $30,000 (the "Contract Price").
