2. Why lower the emergency spillway when the primary, 4-inch riser could be raised to <br />hold the desired pool of water? Lowering the emergency spillway will not achieve the <br />purpose of storing a 1.8 acre-ft pool of water without some mod'+fication to the primary <br />discharge structure. (see next question) <br />3. (new) Rule 4.05.17 requires that a permanent impoundment be renovated to the <br />"detailed design plan for the permanent structure" before abandoning the permit area. <br />The Division understands that the language included on page 482R, (third paragraph <br />from the bottom) constitutes the detailed design plan for the permanent impoundment. <br />Please include with this language what changes or modifications will occur to the <br />primary spillway (4-inch riser). <br />4. (new) Construction of permanent drainages and pond modifications are key parts of <br />the final reclamation plan. Previously the Division has calculated the reclamation cost <br />estimate for the site. Would you like the Division to calculate costs for these two <br />reclamation tasks or would EFMC like to submit an estimate for these tasks for <br />Division review. Please let us know. <br />5. (new)Removal of WSD # 5 will increase flow to the south mine access road ditch. <br />This ditch has been subject to erosion even with WSD#5 in-place.
