<br /> <br />3 <br />Letter: MLRD <br />Re: File No. M-77-210 <br />4/20/90 <br />Project No. 89002 <br />The Important features of this pond are a need to have it in just the <br />right location to fntercept the runoff and to have a sufficient volume to <br />handle the runoff. Any alteration in the design of the pond could <br />compromise the effectiveness of this pond to controlling sedimeni~. <br />In short, we feel we have made all necessary attempts to keep as <br />much of the pond inside the "approximate permit boundary" and still <br />maintain the effectiveness of the pond. To alter the dee:igned <br />characteristics significantly could result in a less effective control. <br />Therefore, we Peel the minimal amount of disturbance beyond the <br />"approximate permit boundary" line is necessary and would urge the <br />Division and the Board to accept Lhe design as presented. <br />QUESTION NO. 4, TOPSOIL SALVAGE. Heffner. <br />RESPONSE: Virtually sll the pond will be excavated into already <br />disturbed land. where excavation will occur on virgin land, what little <br />soil is present wilt be saved. However, keep in mind that the undisturbed <br />areas have quite steep slopes and the amount of soil present is very small <br />to none. The topsoil will be used in reclaiming the land around they pond <br />that is not needed for pond maintenance. Stockpiling oP the soil will only <br />be done until the pond is completely constructed. <br />QUESTION NO. 6, SEDIMENT BASIN RECLAMATION. Heffner <br />RESPONSE: Please refer to pages 19 and 20 in the October 1989 <br />Corrective Action Plan document for a description of the reclamation of <br />the sediment basin area. In essence, areas around the pond not needed <br />for maintenance will be revegetated upon completion of the pond. Once <br />the pond is no longer needed the remaining area will be reclaimed <br />according to the description in the CAP. <br />QUESTION N0. 6, CONTRIBUTING AREA DISCREPANCY. OWA. <br />RESPONSE: The areas used for drainage calculations and sediment load <br />calculations are correct as shown. The difference between the two areas <br />of 1.77 acres occurs since sediment load calculations were completed only <br />on those areas in active mining or in reclamation. The 1.77 acres <br />represents the portion oP the contributing drainage basin that is in its <br />natural undisturbed condition. Sediment loading from the natural <br />undisturbed area will be minimal and was therefore not included in the <br />sediment pond design. <br /> <br />
