Gccd Faith
Through an oversight on my part, discussion of a possible reduction for good
faith was not held during the October 27 conference. However, the conference
was re-opened and the matter was discussed in a telephone conference on
October 28, 1992, including Susan Morrison, Gary Wendt and me.
Upon receiving the NOV on the morning of August 14, 1992, the operator
temporarily pulled the D-5 dozer off the drainage work at the Seneca II-W
Mine, transported it to the Seneca II Mine and completed the necessary
construction work the following day, five days prior to the abatement
deadline. The necessary certification was submitted in a timely manner and
the NOV was fully abated in the required time frame.
Based on the rapid response in completing the construction work in the
shortest time possible given the fact that the equipment necessary to do the
work was not on site the day of the inspection, I recommend a 5250.00 good
faith reduction.
Settlement Agreement Civil Penalty Proposal
History: $ 0.00
Seriousness: 0.00
Fault: 500.00
Good Faith: -250.00
Total Proposed Penalty: 5250.00
DTM/bjw
5273F
