<br />a detailed scope of work setting forth the frequenry, locations, analytical <br />parameters and procedures to be utilized in conducting the sampling and <br />analyses hereunder; <br />2. Pay the third party sampling contractor pursuant to the terms specified in the <br />Contract; and <br />3. Upon proper notice as specified hereunder, provide access to its facilities to <br />the third party sampling contractor for the purpose of conducting sampling <br />activities required hereunder. Nothing herein otherwise I~mits BMRI's <br />authority to restrict access to its facilities. <br />IV. OBLIGATIONS OF DMG <br />Under the terms of this MOU, DMG shall: <br />I. Select, with the concurrence of BMRI, the third party sampling contractor and <br />independent laboratory to be used to analyze the samples obtained in the <br />third party sampling program contemplated hereunder. <br />2. Direct the sampling and analytical activities of the third party sampling <br />contractor retained by BMRI pursuant to the Contract and the, requirements <br />of this MOU; <br />3. Receive and review data and reports received from the third party sampling <br />contractor and provide copies of all such materials to BMRI; end <br />4. Receive and review invoices issued by third party sampling contractor and <br />transmit comments to BMRI. <br />V. ADMINISTRATION OF THIRD PARTY SAMPLE COLLECTION <br />A. Sampling Location and Frequency <br />1. Independent sampling, and subsequent sample analysis conducted by <br />an analytical laboratory retained by the third party sampling contractor, <br />shall be conducted at DMG's direction ~Itree tiriCe daring the first <br />three calendar months following final approval of the TR No. 006 <br />protocol and the execution of the Contract, Arid twice during escl'd#' <br />the subsequent three (3) month periods, <br />-2- <br />
