Ungefug Southway Construction Company, Inc. 1117 Whii:e Pine Drive Alamosa, Colorado 81101 RE: Fillmore Pit, Permit No. M-90-144, 112 Reclamation Permit, Amendment No. AM-001 Dear Mr. Ungefug: I have reviewed your amendment request to incorporate existing permit M-89-096 into perrtiit M-90-144 and to expand the permit boundary of M-90-144 to encompass a total of 84 acres. Enclosed is a list of adequacy questions and review comments from other agencies which must be addressed prior to the decision date of July 9, 1992. MLRD Adequacy Questions / i. It appears that a nationwide permit is required by the Corps of Engineers. An application should be submitted to the Corps prior to July 9, 1992. Please see attached comments. / 2. The Division requests that Southway Construction incorporate the Colorado Division of Wildlife's recommendations of a 100 foot buffer zone around mature cottonwood trees and temporary restrictions on grazing following seeding into the permit amendment. Please see attached comments. /3. Southway Construction, Inc. must submit a copy of a properly executed lease agreement or proof of right of entry for the 84 acres to be permitted. Exhibit A - legal description lists portions of Sections 25 and 19, while the copy of the lease agreement with option to buy material lists portions of Sections 23, 25 and 30. These discrepancies must be resolved. ~ 4. Southway Construction, Inc. must submit 5 sets of an index map, a pre-mining and mining plan map, and a reclamation plan map in accordance with Rule 2.1.2 of the Minerals rules and Regulations.
