N.63°21'11"W. along said tangent, a distance of 899.35 feet, more <br />or less, to a point on the West line of the East forty-seven (47) <br />acres of the West One-half (W-1/2) of said SW-1/4; <br />thence N.00°58'02"W. along said West line, a distance of 1,756.90 feet, <br />more or less, to the Northwest corner of said East forty-seven (47) <br />acres; thence N.89°52'29"E. along the North line of said SW-1/4, a dis- <br />tance of 2,163.315 feet to the point of beginning; containing an area of <br />109.93 acres, more or Less." <br />Zoning Conformance: <br />That portion of the proposed permit area under City jurisdiction is zoned CN <br />(Conservation). This zone district does not permit any type of mining activ- <br />ity as a use by right. "Mineral and aggregate resource excavation and pro- <br />cessing of sand, gravel, rock, earth, and other similar materials" are per- <br />mitted in the CN (Conservation) Zone District only upon approval of a special <br />use permit by the City of Lakewood Planning Commission. To this date, no <br />request for special use permit for the affected property has been submitted to <br />the City of Lakewood. The Robinson Brick Company should contact the City of <br />Lakewood Planning Division as soon as possible in order to avoid any unneces- <br />sary delays in processing the special use permit request. <br />The City's comprehensive plan Concept Lakewood also addresses land use for the <br />subject property. Prior to submission of a request for a special use permit <br />for the mining activity, a definitive response regarding compliance with <br />Concept Lakewood is not feasible. However, in the Parks, Liesure, and Open <br />Space Master Plan, the administrative document adopted by the Planning Com- <br />mission to fulfill the intent of Concept Lakewood, that portion of the pro- <br />posed permit request within Lakewood is shown as being existing open space <br />land as part of the Hayden Green Mountain Park. It is the stated intent of <br />this plan to assure that lands designated as open space remain undeveloped or <br />at most developed for low intensity, passive recreation uses. The proposed <br />mining activity would appear to preclude use of this area as an Open Space <br />area, the purpose for which it has been acquired and designated. <br /> <br />
