An affidavit of publication was not located in a search of MCC tiles related to LRP <br />operations within 100 feet of the new Highway 133. MCC refers the Division to the CMLRD <br />Findings Document for the LRP permit revision, page 67, which states in pertinent part, "In <br />addition an opportunity for a public hearing at the mine site was provided and publicized in a local <br />newspaper. No requests for a public hearing were received." Since the Division made the finding <br />that the publication was made, the question of the affidavit of publication appears moot to MCC. <br />10. The U.S. Steel laydown area pile and the main refuse pile east of the administration <br />building are all references to the lower refuse pile and/or its predecessors in the same location. <br />The waste rock and mine developmen[ waste pile that was temporarily stored on [he portal bench <br />was material from the slopes development and miscellaneous ventilation construction. This <br />material was hauled to and disposed in the lower refuse pile. The initial waste rock pile and the <br />initial waste rock pile area are in reference to a temporary refuse pile a[ the site of the current <br />shop bench. By review of the certified quarterly reports, it is apparent that all of this material was <br />moved or disposed of in the following manner. In the third quarter of 1984, material at the shop <br />bench area was removed to the U.S. Steel wash plant in Utah for processing. In the fourth <br />quarter of 1984, some material was hauled to the portal bench fill at the Blue Ribbon Mine (with <br />the Division's approval), some was hauled to the east portal bench fill, and some to the LRP (then <br />known as the U.S. Steel laydown area). By the second quarter of 1985, remaining waste rock <br />material had been incorporated into the new shop pad. <br />With respect to the underdrain at the LRP, as stated previously, the Division has all the <br />information and reports MCC has. It is possible that some photographs of the underdrain exist in <br />archived engineering files, but these files are not readily available. MCC did uncover the bottom <br />of the underdrain during construction in the summer of 1994. These photographs document the <br />underdrain existence and configuration, and will be submitted to the Division for the 1994 third <br />quarter report. <br />14. Page 2.03-1 has been revised to reelect the relationship between ARCO and Atlantic <br />Richfield Company. <br />RECLAMATION <br />4. Map 34 has been revised to include SG-2. Updated copies of this map were submitted <br />with recent responses to PROS. All the information requested by the Division is or should be <br />present in Exhibit 12.
