For your information the NOV was received in our office by mail on March 29, 1996. <br />1) The issue of pumping from the pit to a sedimentation pond is not a new issue at <br />Colowyo. In the past we have pumped a limited amount of water from the initial West Pit <br />Development to the West Pit Pond. In terms of ground water, the West Pit has been dry. The pumped <br />water was simply surface nmofffrom within the confines of the pit. The water was clean and clear and <br />essentially absent of suspended sofids or other constituents that would pose any problem whatsoever <br />to the operation of the sedimentation pond. <br />2) Because ofthe clarity ofthe water, the pumped water was no different from the water <br />entering the West Pit pond from normal precipitation and snowmelt events occurring concurrently at <br />the time ofthe pumping. The flow was tenor and routinely handled as if it were just normal springtime <br />runoff occurring over an extended period of time. <br />3) Since the Permit did not address pumping, the Division requested that we add such <br />language to clarify that we would be conducting pumping. Colowyo attached a revised page 4.05.6 <br />to the Permit as part of Minor Revision No. 33. (The page is attached for your information.) <br />4) On December 28, 1995, the Division requested additional information regarding the <br />quantity of water to be pumped into a pond and to verify whether the pond could handle the flow. We <br />responded by a letter dated January 5, 1996, indicating, in absolute good faith, what our past <br />experiences had shown. The flows from pumping were minor, consisted of high quality water, and <br />could be very easily handled by the pond. <br />
