M. S. Hayes
Page 4
June 29, 1990
25. The Operator still maintains there is no groundwater of
any yield within the permit area. Obviously, a dry mine lends
some validity to this position. The available drill hole data
shows that no water was encountered in an,y of the drill holes
over the mine permit area. Further, the mine permit area does
not intersect any major drainages. The Operator submits that
"additional study" is not warranted. I do not know how much
information the Division has on the drill holes overlying the
mine permit area. Please review your available information and
let me know the information you lack.
26. The data collected for alluvial well AA-1 indicates the
quality of the ground water on the west edge of the mine site has
experienced some degradation since 1982. Potential pollutant
sources include the coal stockpile immediately east of the well,
the temporary gob pile which was also east of the well and the
fact that the well is completed near the contact of the alluvium
and mancos shale. The data does not show a consistent upward
trend. The data collected during 1988 looks relatively good com-
pared to that taken during 1987 and 1989. The Operator requests
that this topic be s discussion of a future meeting. Additional
analytical data will be available at that time.
27. The wells at the Bear No. 1 & No. 2 mines were actually
sumps excavated in the alluvium. The "wells" Caere backfilled.
The Operator does not believe that Rule 4.07 is applicable to
this type of "well".
28. The Operator has not located its 1981 permit applica-
tion so this item cannot be addressed.
29. The statistical summaries requested are presented on
pages 2.04-30X, 2.04-30Y and 2.04-30Z. The requested graphs are
presented on pages 2.04-30aa through 2.04-30gg.
30. A proposed cover standard is presented on page 4.15-3.
31. A noxious weed control plan was inserted in place of
the pest and disease control plan on page 2.05-42.
32. Page 4.15.1 was revised to reflect the approved seed
mix presented in Table 10.
33. Pages 2.04-43, 2.05-24R, 4.15-2, 4.15-3 and 4.15-4 were
updated to reflect the actual acreage disturbed during construc-
tion of the surface facilities at the Bear No. 3 Mine. Revised
page 4.15-4 includes a discussion of the topsoil plan contained
in Exhibit 23.
