1 <br /> <br />-2- <br />5. Per our discussions during the field inspection, it seems th t the <br />irregular contour-based boundary will be impractical for sev ral <br />aspects of mining and reclamation. It will be particularly difficult <br />to prevent all of the overbank spoils from leaving the permilt area if <br />the contour method is chosen. Your idea of painting the fence posts to <br />mark the boundary corners is an excellent, simple plan, provided the <br />corners are periodically re-painted to that the equipment opirators <br />will know where the boundaries lie. <br />Please amend both your mining and reclamation maps to reflec the <br />changes in the permit boundaries. Please list the distances along each <br />fence line, and the distance and compass direction of each b undary <br />segment that does not lie along a fence. Amend the bond to Fover the <br />disturbance inside this area. <br />6. Regarding the Phase III area, I have several concerns. Your present <br />mining plan calls fora 25 foot buffer between the Tekavich ence and <br />the top of slope on the west side of the Phase III pit. Top oil may be <br />stored in part of that buffer zone. If, as you propose, the Phase III <br />area daylights to the west into the drainage that runs under the <br />Tekavich fence, and if you leave no depression in Phase III, then the <br />base of the Phase III pit can be no lower than the elevation of the <br />bottom of the drainage ditch to which the pit will daylight. <br />Please commit to assuring that the elevation of the bottom o the <br />drainage ditch at a point 25 feet from the Tekavich fence, a d thence <br />projected at a 3:1 slope to the east, will be the lowest ele ation of <br />the pit 1n the Phase III area. Alternatively, if you secure a damage <br />compensation agreement with Mr. Tekavich to repair damage to his fence, <br />and if you make provisions to prevent offsite damage by erns on and/or <br />siltation, you may elect to mine deeper, if needed. <br />7. The Division is concerned that material will be dumped over i:he banks <br />to the north and thereby affect the vegetation on the north- acing <br />slopes and toward public view. This will not be necessary p ovided <br />care is taken to prevent such activity by confining the scre ning <br />operations to more upland areas or to the southern part of t e permit <br />area. <br />Please address this concern in the reclamation plan. <br />Sincerely, <br />b~6 / ~~~ <br />Harry H.
