The buffer zone variance is granted to haul roads that cross <br />these riparian areas located adjacent to the haul roads between Pits 1 and 2 <br />and between Pits 2 and 3 (application pages 816-83, Volume 2, Rule <br />4.05.18(1)). <br />II. Topsoil <br />A. Pits 2 and 3 are not anticipated to be opened as previously proposed. Hence, <br />topsoil will be replaced at a minimum depth of .5 feet (page 816-126). Should <br />mining progress beyond Pit 1, however, the Division has determined that the <br />B horizon and portions of the C horizon shall be segregated and replaced as sub- <br />soil in order to ensure soil productivity consistent with the approved post-mining <br />land use (4.06.2(3)). Subsoils from Pit 3 will be placed on Pit 2 prior to topsoil <br />placement to ensure adequate depths of non-sodic plant growth medium. <br />III. Sealing of Drilled Holes and Underground Openings <br />A. The Division requires that each hole, well, or other underground opening be <br />capped, sealed, backfilled, or otherwise properly managed (4.07.3). The Division <br />has added Stipulation 23 addressing the need to have all of the monitoring wells <br />on BLM lands sealed and reclaimed by 31 May 2002. <br />The Division has added Stipulation 23 with the approval of Permit Renewal 04, <br />which states: <br />THE OPERATOR IS REQUIIZED TO SUBMIT A PLAN FOR THE <br />ABANDONMENT OF ALL WELLS LOCATED ON BLM PROPERTY NO <br />LATER THAN 25 JANUARY 2002. THIS PLAN NEEDS TO ADDRESS THE <br />PROPER ABANDOMENT AND SEALING OF ALL WELLS AND A <br />TIMETABLE SO THAT ALL WELLS ARE ABANDONED AND RECLAIMED <br />BY 31 MAY 2002. <br />IV. Use of Explosives <br />A. Extractive operations in the 720 Pit and Pit 1 have ceased. Blasting in those pits <br />will no longer occur. However, Pits 2 and 3 may open in the future, though it is <br />not currently anticipated that they will be. As such, the Division proposes to <br />approve blasting at times other than those described in the blasting schedule due <br />to unavoidable hazardous situations (permit application page 816-85ffffff, Rules <br />4.08.3(2)(b)(v) and 4.08.4(2)). <br />Marr Mine Peanil Renewal 04 <br />11 January, 2002 <br />-20- <br />
