11. The Division has made a negative determination for the presence of prime farmland within <br />the permit area. The decision was based on evidence provided by the Soil Conservation <br />Service that demonstrates that no prime farmland mapping units are found within the permit <br />azea (2.07.6(2)(k)). <br />12. Based on information provided in the application, the Division has determined that four <br />alluvial valley floors exist within the permit or affected area. These alluvial valley floors aze <br />found along the Illinois River, the Canadian River, Bolton Draw, and Sudduth Draw, and will <br />be minimally affected by Marr mining activity (2.07.6(2)(k) and 2.06.8(3)(c)). <br />For additional specific findings concerning these alluvial valley floors, please see Section B, <br />XVII. <br />13. The Division has approved the post-mining land use of the operation. It was determined that <br />"Rangeland/Wildlife Habitat" meets the requirements of Rule 4.16 for the permit area. A <br />discussion of the post-mining land use can be found on page 180-127 of the application <br />(2.07.6(2)(1)). <br />14. Specific approvals required under Rule 4 have been granted or are proposed. These approvals <br />are addressed in the following section, Section B (2.07.6(2)(m)). <br />15. The Division finds that the activities proposed by the applicant would not affect the continued <br />existence of endangered or threatened species or result in the destruction or adverse <br />modification of their critical habitats (2.07.6(2)(n)). <br />16. The Division has contacted the Office of Surface Mining, Reclamation Fees Branch. As of <br />this time, March 13, 1996, the operator is current in the payment of reclamation fees required <br />by 30 CFR Chapter VII, subchapter R (2.07.6(2)(0)). <br />SECTION B <br />The following findings and specific approvals are required by Rule 4: <br />I. Hydrologic Balance -Rule 4.05 <br />A. Surface and Groundwater Monitoring <br />The water monitoring program is described on pages 780-107 6b through 780-110 <br />of Volume 2 and subsequently reduced with the approval of Technical Revision <br />19, on 1 l January 2000. This plan is organized into four phases of monitoring <br />corresponding to disturbance at the site. <br />1.
