A fugitive dust or emission permit is not <br />required for the Elk Creek facilities since there has been no <br />major modifications on the surface since 1970 as per Regulation 3 <br />(Regulation Governing Air Containment Emission Noticel• However <br />due to complaints from local residents, the Operator was required <br />to prepare and implement a Fugitive Particulate Emissions Control <br />Plan. That: plan was prepared and implemented.
