<br />Page 44 <br />Hard Rock/Metal Minnrg Rule 2 <br />that an emergency condition exists, whereupon notice shall be provided as <br />much in .advance of the meeting as possible. <br />2.2.3 Agenda Changes or Additions <br />Additions or changes to the agenda after the 10-day notification may be <br />made regarding emergency situations, informational items, and Special <br />Permits as outlined in Subsections 1.4.4 and 1.7.3. ]n this event, the Board <br />will endeavor to give notification, if possible, as outlined above, and will <br />be requin;d to notify any Operator or individual scheduled to be heard. <br />2.3 BOARD QUORUM <br />tostzl (1) Four Board members shall constitute a quorum. <br />(2) The Board shall act by majority vote of members present, <br />except th;rt four (4) affirmative votes are required far any amendment of <br />these Rules. <br />2.4 INP'ORM(AL BOARD OPINIONS <br />(1) Any interested person tray request the opportunity to address <br />the Boatel regarding the revocation of permits, forfeiture of bonds, alleged <br />violations of any permit, ffie Act or these Rules, the amendment of these <br />Rules, or any Notice of Violation and Civil Penalty assessment. <br />(21 Such requests must be submitted in writing, and must state <br />the facts which warrant the Board's consideration. <br />(3) The Board, in its discretion, shall grant or deny the request <br />no later than its next regularly scheduled meeting, and if granted, the matter <br />will be considered within sixty (60) days. If the request is denied, the <br />Board sltiill give its reasons in writing. The affected Operator shall be <br />supplied with a copy of the request and all supporting materials upon <br />receipt of the request. <br />2.5 DECLARATORY ORDERS (Section 24-4-105, C.R.S.) <br />2.5.1 Cause for Seeking a Declaratory Order <br />Any person having an interest which is or may be affected may petition the <br />Board for declaratory order to terminate controversies or to remove <br />uncertaia.ties as to the applicability to the Petitioner of any statutory <br />provision of or any rule or order of the Board made pursuant to the Mined <br />Land Reclamation Act (Section 34-32-101, C.R.S. et seq.). <br />
