<br />Page 12 <br />Bard Roclr/Meta1 Mining Rule 1 <br />(e) a custom mill. <br />1.2.2 Extraction Where Material is Not Hauled Off-Site <br />For sites where the definitions of mineral and mining operation are less <br />cleaz, the Board has determined that the following types of excavations are <br />not considered mining operations and do not require minerals reclamation <br />permits. Extraction and use of construction materials within a defined <br />project azea owned or controlled by the same person, company, or agency, <br />where the materials are not sold or hauled off-site, and where; reclamation <br />of the excavation is assured by project requirements. Examples include: <br />(a) gravel or borrow pits orcut-and-fill excavations <br />located on government lands for local use for construction, <br />m.rinteaance, or improvement of specific projects such as reservoirs, <br />airports, public roads or highways, parks, and river channelization; <br />and <br />(b) agricultural excavations where no material is exported <br />from the site, including land leveling or aggregate excavations <br />opened for landowners' use on their own property. <br />1.2.3 Extraction Where Material is Hauled Off-Site <br />Other activities which do not require a reclamation permit include certain <br />excavations where material is exported from the site but the primary intent <br />of the project is clearly not sale of construction material, neither the <br />Iandowne:r nor Operator receive compensation for the excavated material, <br />and when; specific local government approval guarantees reclamation of <br />excavated areas. Examples include: <br />(a) landfill sites with county or municipality approval in <br />act:ordance with Section 30-20-102(1) or 30-20-105, C.R.S. 1984, <br />as amended; <br />(b) foundation excavation with a local county or <br />municipality approved building permit; <br />(c) water or road tunnel development with local county <br />approval. <br />1.2.4 Minln$ on Federal Lands <br />Aay person who intends to extract minerals on federal lands shall apply for <br />a Mined Land Reclamation Board permit unless specifically exempted by <br />the Board according to the provisions of this Subsection 1.2. <br />
