I. FORMAL PUBLIC HEARING <br />The Formal Public Hearing in this matter (unless noticed otherwise) shall be held before <br />the Board on December 16-17, 2003, at the Centennial Building, 1313 Sherman Street, Denver, <br />Colorado, 80203, Room 318, during the Boazd's December meeting. The Boazd will begin its <br />meeting (unless noticed otherwise) at 10:00 a.m, on Wednesday and at 9:00 a.m. on Thursday. <br />II. PARTIES <br />The Board heard an objection by the attorney for the Applicant that the party objector, <br />Marilyn Boynton, lacked party status because she did not demonstrate an injury caused by the <br />proposed mining operation. The Board denied the objection and verified the following party list: <br />Applicant: Four States Aggregates, LLC <br />P.O. Box 1568 <br />Cortez, CO 81321-1568 <br />Objectors: Marilyn Boynton <br />C/o Mary Elizabeth Geiger <br />Caloia, Houpt & Hamilton, P.C. <br />1204 Grand Avenue <br />Glenwood Springs, CO 81601 <br />Note: The Division of Minerals and Geology ("Division") shall not be a party, but shall <br />participate in the Final Hearing as staff to the Board. <br />III. ISSUES TO BE CONSIDERED <br />Presentations to the Board shall be strictly limited to the issue ofwhether the pending <br />application complies with the requirements of the Colorado Land Reclamation Act for the <br />Extraction of Construction Materials, Section 34-32.5-101 et seq., C.R.S. (1999) ("Construction <br />Materials Act") and the rules and regulations promulgated by the Board. The parties shall limit <br />
