<br />BEFORE THE MINED LAND RECLAMATION BOARD DFC ~ ~ <br />STATE OF COLORADO Division of Minerals and Geology <br />PROPOSED PRE-HEARING ORDER <br />IN THE MATTER OF FOUR STATES AGGREGATES, LLC, FILE NO. M-2001-001 <br />OVER OBJECTIONS <br />THIS MATTER came before the Mined Land Reclamation Board ("Boazd") on <br />October 29, 2003, in Denver, Colorado for aPre-Hearing Conference. The purpose of the <br />Pre-Hearing Conference is to identify parties, determine issues, establish a date for the <br />formal exchange of witness and exhibit lists and to estimate the time for the parties' <br />scheduled presentations at the Boazd's Formal Heazing, as set forth in Colorado Land <br />Reclamation Act for the Extraction of Construction Materials Construction Materials Rule <br />2.7.1. <br />This matter is being heard by the Board as the result of a ruling in a Colorado <br />District Court case, Marilyn Boynton, et al. v. Colorado Mined Land Reclamation Board, et <br />al., District Court Case No. O1CV3425. In that case, the District Court ordered the Board to <br />conduct a second Pre-Hearing Conference in this matter. <br />This Proposed Pre-Hearing Order ("Proposed Order"), and any amendments thereto, <br />shall be effective upon approval by the Board. If any party has objections to the provisions <br />of this Proposed Order, those objections must be raised by a timely motion to the Board or at <br />the final hearing before the Board during the Boazd's deliberations. <br />The Board, having considered the parties' presentations and having been otherwise fully <br />informed of the facts in this matter, hereby enters the following Proposed Order: <br />
