GJP may realign any existing <br />1 roadways on the Property, and create other roads on the Property, as necessary for its operations. <br />' The creation and realignment of roads on the Property shall be done at no cost to Lessor. In planning <br />its mining activities on the Property, GJP shall consult with Lessor in order to develop a layout of <br />the pit area which will be satisfactory to Lessor. GJP shah also consult with Lessor in developing <br />a reclamation plan for the Property. Lessor agrees that any layout of the pit area must be such that <br />' it will allow GJP to economically mine sand and gravel from the Property, and that any reclamation <br />plan developed for the Property must be economically feasible and generally consistent with <br />1 reclamation plans adopted for other similar pits in the Mesa County area. <br />' 2. GJP shall conduct and be entitled to conduct certain activities, and the term of this <br />lease shall commence, as follows: <br />' A. GJP shall proceed with due diligence to apply for all governmental perartits necessary <br />' to conduct its operations on the Property under this lease. Such permits include, without limitation, <br />' a mining permit from the Colorado Division of Minerals and Geology ("DMG"), a conditional use <br />permit from Mesa County, a well permit from the Colorado State Engineer, a state highway access <br />' permit, a flood plain permit, a discharge permit, and an emissions permit. If any of these permits <br />' shall be denied or not finally granted within eighteen (18) months from the execution date of this <br />lease (asset forth in the introductory paragraph), then this Lease shall terminate and be of no further <br />force and effect. Subject to the provisions of Paragraph 2.B., below, the term of this lease shall <br />' commence upon the date of issuance of the last of such permits to be issued (lhe "Commencement <br />' Date").
