Long <br />Division DneUOr <br />I reviewed the proposed sedimentation structures and access road, and have done a reclamation <br />cost estimate for MR 101. As such, I have the following comments: <br />Sediment Control <br />The operator's plan for sedimentation control is adequate, with one exception. The sump that <br />will contain runoff from the coal laydown area is shown with an emergency spillway at an <br />unknown elevation (appears to be lower than 5680). It is my understanding that this sump was <br />to be a total containment structure, with no discharge point. I talked to Dave Anderson, <br />Deserado Mine, and asked him to explain the plan. He said it was to be a total containment <br />structure, but that he believed an emergency spillway was required. As you and I discussed, if <br />the sump has a spillway, it would be required to be an NPDES permitted discharge point. <br />Considering that, I told Dave Anderson that he should either remove the spillway from the <br />proposed sump, or permit the sump as a discharging Qond. He plans to remove the spillway. <br />The new proposal should be for a sump that has no spillways, and provides at least .1 acre feet <br />of storage. If they modify the existing map (TS #2 Sediment Pond), the top of the berm should <br />be at or above 5681. The revised map should also include labelling of the contour lines, as the <br />last map did not. <br />Reclamation Cost Estimate <br />The attached pages provide details of the costs I estimated for reclamation of the proposed <br />structures and improvements.
