I reviewed the proposed sedimentation structures and access road, and have done a reclamation
cost estimate for MR 101. As such, I have the following comments:
Sediment Control
The operator's plan for sedimentation control is adequate, with one exception. The sump that
will contain runoff from the coal laydown area is shown with an emergency spillway at an
unknown elevation (appears to be lower than 5680). It is my understanding that this sump was
to be a total containment structure, with no discharge point. I talked to Dave Anderson,
Deserado Mine, and asked him to explain the plan. He said it was to be a total containment
structure, but that he believed an emergency spillway was required. As you and I discussed, if
the sump has a spillway, it would be required to be an NPDES permitted discharge point.
Considering that, I told Dave Anderson that he should either remove the spillway from the
proposed sump, or permit the sump as a discharging Qond. He plans to remove the spillway.
The new proposal should be for a sump that has no spillways, and provides at least .1 acre feet
of storage. If they modify the existing map (TS #2 Sediment Pond), the top of the berm should
be at or above 5681. The revised map should also include labelling of the contour lines, as the
last map did not.
Reclamation Cost Estimate
The attached pages provide details of the costs I estimated for reclamation of the proposed
structures and improvements. The total estimated cost is $3,879.66.
