Affirmance of Notice of Violation No. CV-2000- <br />009 would affect the Tatums by satisfying their burden of proof in any subsequent civil action for <br />damages based on theirclaim that subsidence of underground workings that comprise part of Basin's <br />Golden Eagle Mine has caused the new damage to Solitario Ranch. <br />6. Conversely, vacation of Notice of Violation No. CV-2000-009 would aggrieve the <br />Tatums by depriving them of the simplest means of satisfying their burden of proof in subsequent <br />litigation. <br />7. To support their damage claims against Basin, the Tatums have obtained expert <br />opinion evidence which supports the validity of Notice of Violation No. CV-2000-009 but which <br />may be admitted to the record of this proceeding only if the Tatums become parties. <br />Counsel for both Basin and the Colorado Division of Minerals and Geology have authorized <br />the Tatums to inform the Board that neither of those parties objects to the relief sought by this <br />motion. <br />-2- <br />
