<br />_, <br /> <br />BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />Notice of Violation No. CV-2000-009 <br />III IIIIIIIIIIIIIIII <br />RECEIVED <br />FEB 1 2 2001 <br />Division of Minerals and Geology <br />UNOPPOSED MOTION OF JIM AND ANN TATUM TO INTERVENE AS <br />ADDITIONAL DEFENDANTS WITH FULL PARTY STATUS <br />Pursuant to Colo. Rev. Stat. § 24-4-105(c), Ann Tatum and Jim Tatum (collectively, "the <br />Tatums") move to intervene in this proceeding as additional defendants with full party status. The <br />grounds upon which the Tatums make this motion are the following: <br />1. The Tatums jointly own real estate in Las Animas County, Colorado, known as <br />"Solitazio Ranch." <br />2. In 1997, the Tatums established through a judgment of the District Court of Las <br />Animas County, Colorado, that subsidence of abandoned underground mining workings in the <br />Golden Eagle mine, for which Basin Resources, Inc. ("Basin") is now legally responsible, caused <br />certain damages to the Tatums' adobe residence structure at Solitazio Ranch. The Tatums attach a <br />copy of the pertinent judgment as Exhibit A to this motion. <br />3. Prior to entry of the 1997 state courtjudgment, the Tatums repaired all of the damages <br />that subsidence of Basin's nune initially caused to their adobe residence. <br />4. Notice of Violation No. CV-2000-009, which Basin challenges in this proceeding, <br />recites that subsidence of Basin's nearby abandoned underground mining workings has subsequently <br />caused additional damage to the Tatums' adobe residence structure. <br />5. Notice of Violation No. CV-2000-009 has affected the Tatums by upholding their <br />claim that the new damage done to Solitario Ranch results from subsidence of underground workings <br />
