Rule 1.6.2(1)(el -General Applicant Procedures Response: The proof ofpublic notices submitted to all owners of record ofsurface lands, easement holders, and owners of record ofsurface lands that are within 200 feet of the boundary of affected land are enclosed with this letter. Rule 6.2.2(2)(b) -Maps and Exhibits Response: The maps have been stamped and signed as reguested and are enclosed with this letter. Rule 6.4.3 Exhibit C -Pre-Minine and Mining Plan Map(s) of Affected Lands Response: The requested modification to Exhibit C-4, Mining Plan has been completed and is enclosed with this letter. Rule 6.4.4 Exhibit D -Mining Plan Response: The reestablished berm is 25 feet wide with 3:1 slopes (See Figure 1). Scrapers were utilized in the reconstruction and the material was wheel roll compacted. The material used for the reestablished berm consisted of shale and overburden. The berm constructed to create the silt storage area is 12 feet wide with 3:1 slopes (See Figure 2). Scrapers were used to construct this berm and the material was wheel roll compacted.
