Ms. Christine Johnston
Mountain Coal Company
Page 9
April 14, 1997
49. The Division requested that MCC locate the three water diversion systems on a map.
MCC responded that the sources for these diversions are located on Map 37. However,
the Division is requesting that the actual structures' locations be shown on a map. Please
provide such a map with these structures' locations on it.
50. The Division believes that permeability tests conducted in one borehole located south of
the proposed exhaust shah location Wray not adequately chazacterize the ground water
inflow conditions that may be encountered during shaft construction. Please provide the
Division with a detailed contingency plan for disposition of ground water in the event that
inflows during construction and operation of both the ventilation and exhaust shafts
exceed the predicted maximum of 25 gallons per minute.
51. MCC has stated that there will not be any mine water discharge through the Sylvester
Gulch pond SG-1 drainage system, other than the temporary discharge of 25 gpm during
shaft construction. The Division still has concerns about base flow, from springs and the
temporary mine water pumpage, as it concerns the Sedcad designs for ditches and
culverts. Please see response number 24 in this letter.
52. The Division has no further concerns. The Division requested that MCC provide a written
commitment of in-compliance discharges. MCC has submitted a revised page 2.05-27 with
the March 7, 1997 submittal.
2.05.3 5 Topsoil
53. The Division accepts the commitment by MCC to replace an average of 12 to 18 inches
of topsoil, as long as it is understood that the 12 inches are a minimum depth of
replacement and not an average between eight and 16 inches, or any other combination
of numbers to come up with a minimum average. Please add, or corcect the document to
confirm this agreement, or understanding.
2.05.4 Reclamation Plan
54. This timetable information provided should be included in the permit application. Please
revise the permit document to include this information.
55. DMG is still in need of additional information to be used in developing a reclamation cost
estimate, as described in this letter. As previously requested, the additional information
should be included in the appropriate section(s) of the permit application package. MCC
did not revise the permit application text to incorporate all of their March 11, 1997
responses.
