Ms. Christine Johnston
Mountain Coal Company
Page 8
April 14, 1997
structures aze shown on the new Drawing E611305A, also submitted on March 8, 1997.
The locations are designated as each of the "sediment control boundary" on the drawing.
42. The Division has no further concerns. Upland ditches have been added to the drainage
designs for the five SAES. The locations are shown on Drawings E611105A and
E611305A. These drawings refer to ditch type A, which is shown on Drawing E611307A.
These three new drawings were submitted on March 7, 1997.
43. The Division has no further concems. The data for subwatershed 40B has been revised
in Attachment 43E-1, which was submitted on March 7, 1997.
44. The Division has no further concerns. The reference to Table 42E has been corrected.
Page 2.05-29 has been revised in the Mazch 7, 1997.
45. The Division was concerned about the update of the NPDES permit and the appropriate
pages in the DMG permit application, now that pond SG-1 is being proposed. MCC
responded that a revision will be filed for the incorporation of the new NPDES permit
into the DMG permit application. At that time, the Division will review the NPDES
permit and any revised pages of the permit application.
46. The Division has no further concerns. MCC has stated that there will not be any
relocation of Sylvester Gulch. Exhibit 69 has been revised in the March 7, 1997 submittal
to reflect this.
47. The Division was concemed about whether any proposed ditches would be located in
landslide or otherwise unstable areas. MCC responded that, other than some roadside
ditches, no ditches would be located in landslide areas. However, MCC has decided to
install a culvert, CCW-1 B, to replace the previously proposed clean water ditch DCW-6B,
in order to avoid the steep terrain on the south side of the shaft site. The Division
appreciates that MCC is attempting to avoid potential problems with a ditch on steep
terrain. However, the Division has concerns about a 2380 foot long culvert. Maintenance
of that culvert could be difficult due to the inaccessibility. Problems could be difficult to
spot, and difficult to solve. The Division would like MCC to reconsider this issue and
decide the best solution to the problem, keeping in mind all of the factors.
48. The Division has no further concerns. All of the culverts associated with Sylvester Gulch
crossings are now designed for the 100 year-24 hour event. Revised Sedcad designs were
submitted on March 7, 1997.
