Box 591 <br />Somerset, Colorado 81434 <br />Re: Review of Adequacy Responses to Permit Revision No. 7 (Sylvester Gulch Facilities <br />Area); West Elk Mine (Permit No. C-80-007j <br />Deaz Ms. Johnston: <br />The Division has reviewed Mountain Coal Company's (MCC's) responses to the Division's <br />comments regarding the Permit Revision No. 7 application for the Sylvester Gulch Facilities Area <br />(SGFA). Based on our review of your responses, additional information will be required from <br />MCC. The Division has the following remaining comments regarding the March 7, 1997 PR-07 <br />adequacy response submittal. The comments numbered below correspond to the same numbered <br />paragraphs contained in our original review letter dated January 15, 1997. <br />In response to our initial adequacy questions dated January 15, 1997, MCC submitted information <br />that brought up additional adequacy concerns. These additional questions refer to ponds, <br />impoundments and diversions (Rule 2.05.3(4)) and aze included below as comment numbers 86 <br />through 104. <br />General Information <br />1. MCC has added a general discussion which addresses future plans for the SGFA to <br />Exhibit 69. The revised information provided with the March 7, 1997 submittal is <br />deemed acceptable. No further response is required. <br />2.03.4 Identification of Interests <br />2. No response is required from MCC. <br />
