Lochhead <br />Executive Director <br />Michael B. Long <br />Division DireUOr <br />This letter is meant to convey information and request responses <br />about several as yet unresolved issues. Regarding the problems and <br />violations at the several gravel sites with which the county is <br />involved, this Division communicated to you the Mined Land <br />Reclamation Board's request for a written proposal outlining how <br />said problems would be addressed. The Division and the Board have <br />received reassurances from the county that such a proposal would be <br />submitted. At the June 1995 Board meeting Mr. Devereaux, <br />representing Costilla County, presented a verbal outline proposal <br />with a promise to submit the written proposal. The written <br />problems and violations must still be submitted. A prompt response <br />is regarded as a good faith effort. Please note that this outline <br />should include information pertinent to the unpermitted activity at <br />the site south of San Acacio, MLRB File No. M-77-502. <br />Regarding the Sierra Grande Site, File No. M-94-103, the permit <br />application is still not complete. Correspondence to the county <br />from Barb Chiappone of our office, dated June 23, 1995 listed <br />exactly what was still needed to complete the application. Please <br />submit these soon. A second issue concerning that site is the <br />discovery of resumed mining, during my inspection of July 6, 1995. <br />This is a violation of a Board Order, and you will receive a letter <br />notifying you of that possible violation. <br />Finally, concerning the notices for possible violations at the <br />Costilla Pit ~1, Permit No. M-77-044 (near Los Fuertes), and the <br />hearings for these matters, the hearing date has been changed. <br />Your original notices stated that these matters would be heard at <br />the July 26-27, 1995 Board meeting. The hearings have been <br />postponed until August 23-24, 1995. The matters involve <br />insufficient topsoil reserves, lack of proof of notification of the <br />Division of Water Resources about the pond there, lack of a site <br />
