Terry McKee
Request for Isolation Concurrence for Asphalt Specialties Co. -Speer Property
Page 2
It has been the opinion of the U. S. Army Corps of Engineers, Omaha District Office, that
man-induced wetlands aze considered non-jurisdictional. The man-induced waterway
that is now presem on the Speer Property was created due to dewatering of an active
mineral extraction azea and would revert to uplands if the water source were to be cut off.
In that regazd, the wetlands are not waters of the United States, and should be considered
non-jurisdictional.
If the Corps agrees with our findings that the above-described feature is man-induced and
therefore non jurisdictional, please provide us with a concurrence letter to that effect. If
you have any questions, please contact us.
Sincerely,
~~~1.`- ~~v~e.
Edith Savage
President
Attachments: Figures I - 5
c: Rob Laird, Asphalt Specialties Co.
