ASPHALT <br />SPECIALTIES CO. <br />disturbed azeas and that the soils have severe limitations for crop production unless <br />cazeful management is practiced. <br />Exhibit J -Vegetation Information <br />There are two principle vegetation types present on the amendment azea. One is non- <br />native grasses and weeds covering the developed and historically used portion of the <br />property and the other is marginal riparian vegetation on the lower bench area adjacent to <br />the South Platte River. <br />The northwest portion of the property, referred to as the lower bench azea, is dominated <br />by open cottonwood riparian woodland found in association with the primary alluvial <br />terrace of the South Platte River. This azea contains old cottonwood trees and <br />monocultural stands of reed canarygrass. This area will remain generally in its present <br />state as mining will not occur here and which is not planned for any disturbances other <br />than riverside protection consisting of rip-rap and other improvements (topsoiling and <br />revegetation) on the bench of the high-water bank as shown on the Mine Plan Map. <br />Appendix 2 contains a report for isolation concurrence for aman-induced waterway on <br />the amendment area. This is an artificially irrigated drainage ditch. This isolation <br />concurrence was agreed to from the U.S. Army Corps of Engineers and mining could <br />proceed in the amendment area. There are no jurisdictional wetlands located on the <br />amendment area. The report and "concurrence' letter are both contained in Appendix 2. <br />Also, a memo is contained in the appendix describing the completion of wetland <br />disturbance on the current permit azea. <br />A habitat assessment has been performed for Spiranthes Diluvialis on the amendment <br />azea. Based on this assessment, there is no potential orchid habitat within the amendment <br />area and this statement has been corroborated by the U.S. Fish and Wildlife Service with <br />a letter of agreement provided by them. The assessment report, and letter from the U.S. <br />Fish and Wildlife Service, are contained within Appendix 2. <br />Exhibit K -Climate Information <br />Climate information for the amendment azea is exactly the same as that for the current <br />permit azea. A substantial description for the climate of the current permit area was <br />submitted with the first amendment application for M-1983-176 in September 2000 and <br />will not be repeated here for the sake of redundancy. <br />Speer Mining Resource 2I October 7, 2002 <br />Asphalt Specialties Company, Inc.
