He sent this letter out on February 16. <br /> 10 Not precisely knowing what the problem was, but knowing that <br /> 11 having no notice to the Eagle River Trust that since he rep- <br /> 12 resented the Eagle River Trust in the past that he better get <br /> 13 something done.. In the meantime, he contacted us and said <br /> 14 you guys may want to handle this, I may have a conflict of <br /> 15 interest even between Brush Creek and Eagle River Trust. <br /> 16 Maybe these 2 parts are different, maybe since they, Brush <br /> 17 Creek, sold the land to Nottingham at this point, will object <br /> 18 to this situation, but Eagle River has different interests. <br /> 19 I might point out at this point that some of the interest <br /> 20 might be quite substantial . The indication in the applica- <br /> 21 tion is that all of the surrounding land is agricultural-- <br /> 22 Eagle River Trust has a recreational use. They have a shoot- <br /> 23 ing permit in that area. A special shooting permit which has <br /> 24 been issued to them and I don' t know what the potential <br /> 25 problems here are, but conceivably there might .be a very <br /> 26 direct injury to personal life in this area. So there' s a <br /> 27 recreational prime use permit which has been granted to Eagle <br /> 28 River Trust and is contained in this land. <br /> 29RW: That would be a county question, would it not? <br /> -22- <br />
