If you' re just in the <br /> 6 vicinity that doesn' t necessarily count, if you're adjacent <br /> 7 owner to the affected land or just. <br /> SG: We' re touching the affected land, contiguous adjacent or <br /> 9 touching whatever the word is. <br /> 10 RW: You' re alright, Mark. <br /> 11MH: There' s 2 adjacent landowners, immediately adjacent land- <br /> 12 owners, Railroad and Brush Creek and Eagle River Company. <br /> 13G: Well, that may not be updated as of October of 1978, the land <br /> 14 was deeded as of record October 2 to Eagle River Trust, Brush <br /> 15 Creek is no longer an adjacent or contiguous landowner, in my <br /> 16 understanding. The land belongs to Eagle River Trust at this <br /> 17 time and has for the last 4 months or so. <br /> 18 [Unintelligible. ] Let' s stay with these 1 by 1. <br /> 19RW: When' s the date of the application? <br /> 20MC: I 'd like to respond to the notice question. I don' t really <br /> 21 want to challenge Mr. Goldstein' s good faith in making that <br /> 22 assertion, but I am very troubled by that assertion because <br /> 23 the Brush Creek Company is the company from whom Mr. Notting- <br /> 24 ham acquired his property and they have continued to deal <br /> 25 with the Brush Creek Company throughout the period of time <br /> 26 and even until this time. There is a principal , as I under- <br /> 27 stand, in the Brush Creek Company. The application will <br /> 28 reflect the fact that the deed, by which Mr. Nottingham <br /> 29 acquired his property, was signed by an individual named <br /> -16- <br />
