Permit Revision No. 7 -Responses <br />March 7, 1997 <br />Page 4 <br />14. MCC cannot state that the azea will not be used for a refuse disposal area during the <br />remaining life of the mine. The pile has been partially approved and included in the permit. <br />However, MCC can commit to maintaining the Historic Record Study Area in its current <br />state for the time period required to acquire the necessary historic record vegetation <br />information. This statement has been added to page 2.05-69. <br />Fish and Wildlife Information (2.04.11) <br />15. Page 2.04-176 has been revised to reference the Threatened and Endangered Species Survey <br />conducted in September 1996 for this revision submittal. <br />16. MCC has revised the September 1996 "Threatened and Endangered Species Survey for the <br />Sylvester Gulch Area" prepared by Westec, to include and specifically identify those <br />proposed or federally listed species which could potentially occur on the proposed <br />disturbance area or adjacent areas. In addition, the report was revised to include a detailed <br />discussion of the methods used to identify and survey potential habitat for the proposed and <br />listed species. Appendix A has been added to the report, which includes a letter received <br />from the U.S. Fish and Wildlife Service listing threatened, endangered, or candidate species <br />which might occur in the area. <br />17. The annual water depletion estimate is included in MCC's permit in Exhibit 67. This <br />estimate does not change with the addition of the Sylvester Gulch Facilities Area, as the new <br />facilities will not effect MCC's water usage. The annual water depletion estimate is <br />primarily based on the rate of production (i.e., with more coal mined, more water is <br />needed). A conservative estimate for surface use and evaporative losses are included in the <br />current depletion estimate and the SGFA is covered in this estimate. <br />Oueration Plan -Permit Area (2.05.3) <br />18. Narratives describing the facilities to be located in Sylvester Gulch are included in the permit <br />text beginning on page 2.05-16. Amore detailed description of the facilities is provided in <br />the Project Description of Exhibit 69. The maintenance that will be performed on the <br />substation, power line, and ventilation shafts will be minimal and is self-explanatory. No <br />additional revisions to the text have been made. <br />A description of the removal plans for each of the facilities is discussed in the responses to <br />the questions in the Reclamation Plan section of this letter. <br />Response to the Division's geotechnical concerns regarding the construction and operational <br />phases of the Sylvester Gulch facilities aze in the response to question 71 below. <br />
