For a larger one--
MR. FRENCH: I don't think I said every day.
I said that operation has been going on since 1890.
MS. WINTER: Well, then it's been in violation
every day since permits were required and that means if it's
a larger operation, it's $100 a day. That's a substantial
bond.
Now I wouldn't expect that the Board would
levy a fine of that nature without caaiving some of it, but
I would suggest that perhaps it's time for us to start levying
the fine that is required by lac/. I would expect that we
would waive a major portion of that; but I think we ought to
be applying the law. The law is very clear on that.
I think there are some things that we could
use to evaluate how severe the violations are and I've listed
several of them here and I've also tried to give them an
importance rai.-ng.
I think whether or not reclamation has been
occurring; whether or not the operation is permitted, is
a very important thing to consider because if the operator
has been reclaiming the land, even though he didn't have a
permit, then it certainly makes it much less of a severe
situation.
The same is true if there are no hazards on the
ElI FEA' G9RPbYTFR R A.SSOC/A TF.S !]C
CvrnGnl.Shunhand Rrpa.vn
lspp Cherr r~~illr Rna/
Liu lrrnn.
