WnF <br />Drvivun Director <br />Raton Creek Mine, C-82-055, NOV-C-95-022, Abatement and Good Faith <br />Effort <br />This memo serves to document the additional measures Energy Fuels Mining Company <br />implemented in their abatement of NOV-95-022. <br />NOV-95-022 was written on September 1,1995 as the result of my inspection conducted on <br />August 30, 1995. The violation was written for failure to maintain sediment control <br />structures to design specifications. <br />Abatement steps required included: <br />1) Repair Refuse Ditch No.l to comply with permit design specifications, by October <br />15, 1995. <br />2) Repair silt fence at Topsoil SAE to comply with permit design specifications. This <br />step needed to be complete by September 15, 1995. <br />3) Identify in the permit a person to act as inspection and remediation contact at the <br />mine site, by October 15, 1995. <br />Energy Fuels Mining Company submitted revised Correspondence Information to include <br />in the permit, designating the inspection contact to be Mr. Al Weaver. This was submitted <br />on September 15, 1995. This fulfilled abatement step No. 3. <br />The Division conducted an inspection of the Raton Creek Mine on September 29, 1995. <br />The Topsoil SAE silt fence had been repaired. Additional reinforcement of the silt fence <br />had been added with straw bales abutted upslope of sections of the silt fence. Several <br />additional lengths of filter fabric had been installed upslope of the designed silt fence to <br />provide additional control. The inspector noted that reconstruction of the Refuse Ditch No. <br />1 was progressing, yet appeared to be almost complete.
