The TDN was written for, "failure to <br />plate in a controlled manner and consequently compact in lifts no greater than <br />4 feet, the excess spoil placed in the valley fill located in the Wolf Creek <br />revision area (Rule 4.09.2(3) cited). <br />The Division finds that a violation does not exist and does not Ulan to take <br />an enforcement action. The method of placement of material in the Wolf Creek <br />Fill (.gravity segregation) was approved by the Division in the Permit Revision <br />No. 1 findings document of September 25, 1984. The method of construction was <br />found to be co consistent with and approvable under the "alternative <br />specifications" (Rule 4,09.1(3)) in the Colorado Regulations. Since Peabody <br />is in compliance with the approved permit and the applicable performance <br />standards, the Division does not find that a violation exists. <br />The Albuquerque Field Office raised a question regarding interpretation of the <br />performance standards concerning excess spoil. The Division interprets the <br />"alternative specifications" performance standards for fills to apply to all <br />fills.
