The Board <br /> 7 should consider that level of penalty it wishes to set bearing <br /> g in mind that this disturbance has existed continuously since <br /> 9 July 1st of 1976. And counting today, that's a t'~tal of 1820 <br /> 10 days. Mr. Doughty hss been aware of the act from the entire <br /> 11 time and his potential penalties, if we did a strict i <br /> 12 interpretation of the law, is from 591,000 to $364,000, <br /> 13 depending on if we give S50 a day or $200 a day. <br /> 14 I wanted to mention this just to s~~rt of give <br /> 15 you a little perspective on what I'm going to recl~mmend. I <br /> 16 recommend that the .5oard give a maximum fine of 5200 a day for <br /> 17 20 days of operations, which would work out to 54,00, and <br /> 18 suspend the greater part of it upon issuance of a permit to <br /> 19 this operation. <br /> 20 Th_ >~~spension is up to the Board.
