That all construction shall meet the required standards <br />of the La Plata County Permit System and the La Plata <br />County Floodplain Management Regulations. <br />9. Amended for clarity to: All Phase 3 landscaping shall be <br />installed prior to initiating excavation on Phase 3. <br />Minimum size shall be 2" caliper for large trees and 5 <br />gallon for small trees and shrubs. Landscaping shall be <br />maintained and replaced as necessary. <br />10. Changed to read: Normal hours of operation shall be <br />limited to 7 A.M. to 6 P.M., Mondays through Saturdays <br />except when an extraordinary and unusual hardship <br />condition, caused by more than 1 day of bad weather or <br />equipment breakdown in that week, exists. Sixteen-hour <br />operation, 5 A.M. to 9 P.M, and Sunday operation more <br />than four Sundays per year shall follow the neighborhood <br />notification procedure outlined in Mr. Gosney's 11/5/92 <br />letter. The gravel crusher a_Tall not be operated on <br />Sundays. <br />Commissioner Baty suggested the following language be used to <br />clarify Condition 10: "Normal hours of operation shall be limited <br />to 7 A.M, to 6 P.M., Mondays through Saturdays except when there <br />exists an extraordinary and unusual hardship condition caused by <br />more than one day of bad weather or equipment breakdown in that <br />week." <br />Public Hearing Portion: <br />Brian Kimmel, Agent for Gosney and Sons and Don Gosney, in <br />summary, made the following comments: <br />1. While he is sympathetic with neighborhood concerns <br />regarding noise and pollution, permission for Gosney & Sons to <br />use the property for gravel mining was granted by the Board of <br />Commissioners in 1987. This permit preceded much of the <br />residential development in the area. <br />2.
