. ~ <br />s~" <br />~~ ~~~ <br />~'y~ ~~ <br />Q~ ~,~ <br />,~ <br />The applicant shall enter into a Development Improvements <br />Agreement with the County or obtain an official release <br />from the County Engineer on the Road and Bridge <br />Departments required driveway improvements prior to <br />recording of the final plat. <br />Unanimously approved. <br />DE NOVO HEARING <br />PROJECT NO. 93-191 GOSNEY & SONS, PHASE 3 OF MASTERPLAN - <br />This is a request for final approval of Phase 3 of the Master <br />Plan for mining operations. This project is located approximately <br />2 miles SE of Bayfield off of CR 521; Section 14U, T39N, R7W. <br />Since the Planning Commission Hearing on this matter held <br />October 7, 1993, adjacent landowners, Randy Houtz and Jim Friedley, <br />have written letters requesting a de novo hearing have been <br />received. Neither of the letters request denial of the project. <br />Carolyn Hunter, Associate Planner presented the Staff Report <br />incorporating additional information and amendments to the original <br />conditions resulting from investigation of areas of concern raised <br />in Mr. Houtz's and Mr. Friedley's letters. <br />The Staff Report recommendation was for approval of this <br />project subject to the new proposed conditions. That all verbal, graphic and written representations of <br />the applicant are deemed conditions of approval. <br />2. In the event that a court of competent jurisdiction in an <br />action brought by the Applicant shall find that any <br />condition of approval of any permit shall be invalid for <br />any reason, it is the declared intent of the Board of <br />County Commissioners that the entire permit shall then <br />become void, and the underlying land use unlawful and <br />prohibited pending a new application approval. <br />3. That the Applicant install the accel/decel lanes per the <br />requirements of the County Engineer. (Change: The <br />Planning Commission voted to delete the phrase "once the <br />speed limit study is complete" from this condition.) <br />9. That the Applicant implement the Wildlife Mitigation Plan <br />to the greatest extent practicable. <br />5. That the Applicant stockpile gravel between the gravel <br />crusher and the adjoining neighbors to the greatest <br />
