The report, combined with the numerous meetings and phone conversations we have had regarding the subject, has led us to the conclusion that proposed mediation will require modification of Coolcy's mining plan. Coolcy's current mining plan was approved by the Jefferson County Board of Adjustment, and until recently could have been modified only by the Board of Adjustment. However a recent amendment to the leffcrson County Zoning Resolution now requires that a Special Use be approved by the County Commissioners in order to modify an approved mining plan (Section 41 B. 4. a. (3), copy attached), This change to the Zoning Resolution was approved by the County Commissioners on June 1, 1993. 'To confvm our conclusion, 1 spoke to Carolyn Justice, Assistant County Attorney, regarding this matter.
