<br />In summation, we felt that any revision to our DMG permit, with regard to the east highwalls, <br />was not required at this time because there are not any plans to implement any remining in that <br />area for many months to come, if at all. The east highwalls are currently "off limits" to <br />personnel and machinery and are slowly working their way to a natural angle of repose. No <br />further tension cracks have developed east of the furthest east tension crack noted in October of <br />1992. In short, due to County caning, we are caught between "a rock and a hard place". <br />3) With regard to current mining within the quarry, the highwall and bench <br />configuration is currently being mined to a final 80 foot highwall by 40 foot bench. This <br />configuration was submitted and approved by the MLRD in 1982, as shown on the mine plan <br />map (see portion attached). However, the text of the submittal reads 80 feet by 80 feet benches <br />and highwalls, which is in direct conflict with the map. This was an oversight on our part and <br />was not "flagged" by the MLRD on the 80 foot by 40 foot configuration. Approval of the <br />Central Quarry expansion, approved by the MLRD in 1979, showed and described, both on map <br />and in the text, the 80 foot by 40 foot configuration. The 1982 expansion to the south was <br />designed to "dovetail" onto the Central Quarry expansion of 1979, with the 80 foot by 40 foot <br />configuration. <br />The proper text change to the 1982 approval should be implemented. <br />In closing, we sincerely regret the confusion brought about by the inability to gain approval for <br />a minor expansion from Jefferson County, thereby allowing us to submit the proper T.R. or <br />amendment to the DMG. We fully intend to submit the required application during or prior to <br />actual remining of the east highwalls, as per DMG regulations, and Mr. Humphries letter of 10- <br />29-92. However, no remining will occur, as stated above, for at least 7 to 8 months. <br />If requested by the DMG, we will submit the required amendment application, as specified in <br />the SOE, by 8-21-93 showing the interim mine plan.
