As we <br />discussed in previous correspondence and at the meeting, Somerset <br />does not believe that a pattern of violations exists with respect <br />to the mine. Rather, the notices of violation which have been <br />issued by your staff over the past year reflect a series of <br />isolated problems with respect to unrelated requirements of the <br />Rules and/or the above referenced permit for the operation. Each <br />of the problems have been addressed in a timely manner and in a <br />fashion intended to avoid repetition of the problems cited in the <br />notice. <br />It is the policy of this Company to operate the mine in strict <br />compliance with the applicable requirements of all statutes, rules <br />and permit conditions. Therefore, even the issuance of a single <br />violation is a matter which is taken seriously by the Company. <br />This letter is written to advise you of the following steps which <br />the Company is taking to address the issue of environmental <br />compliance at the mine: <br />1. The Company had budgeted to hire an environmental <br />compliance coordinator in June of this year. As we discussed at <br />the meeting, the Company has expedited this schedule and has <br />retained a personnel search service to identify potential <br />candidates for the position as soon as possible. This position <br />will report directly to management and will have the requisite <br />authority and budget to assure that the required compliance <br />measures are implemented. <br />P.O.
