This will require
suitable protection.
Hydrology
Rule 3.02.2(2) requires that the Division make a "determination whether pollution of
surface or subsurface water is occurring, the probability of continued pollution, and
the estimated cost of abating such pollution". The Division has made a negative
determination that water pollution is occurring or will occur. The Division bases this
findings on the operators proper implementation of designs, maintenance, and
monitoring as approved in the permit application. All ponds are designed, at a
minimum, to contain and treat surface runoff from a 10 year, 24 hour event. All
runoff from disturbed areas pass through these treatment systems. Past NPDES
monitoring do not show that pollution is occurring. The Division does not expect that
there will be groundwater pollution. There is no toxic overburden to cause water
pollution. This past winter, prior to backfilling the 720 pit, water had to be
discharged under an industrial discharge permit. This water was a mixture of surface
run-off and groundwater that had been in contact with spoils for many years.
Bio-monitoring of the discharged pit water met NPDES water quality standards.
Marr Strip, Bond Release 4 May 24, 1994
