Mr. Prir_e also provided me with a <br />copy of an agreement between American Shield and MLRD which was <br />negotiated S/31/89 and signed by MLP.D on 9/8/89. Briefly, the <br />agreement requires American Shield to securely seal or close all <br />portals by 9/19/89 and to submit to MLP.D by 9/20/89 an adequate <br />reclamation plan. OSM/Albuquerque Field Office will monitor this <br />reclamation plan submittal and approval/implementation. Mr. Prir_e and <br />I agreed that the areas of concern noted would be cited in a MLRD <br />notice of violation to be issued from the MLP..D office. This issuance <br />(C-89-0217 was confirmed via telephone with Mr. Price on 9/18/89. Mr. <br />Price indicated tFie agreed upon areas would be cited under provisions <br />of, Sec. 4.05.1 Hydrologic Palance: General Requirements. This also <br />was discussed on the minesite. <br />I referred Mr. Price to Mr. Bruce Fowler, USDI/BLM in Grand <br />Junction cr_,ncerning the status of nine (9) observation wells which <br />were completed for this project on PLM land. I discussed my <br />inspection findings with Mr. Fowler via telephone on 9/18/89 and gave <br />him the appropriate MLP,D contacts concerning this minesite. I also <br />discussed with bath BLM and MLRD the status of the haulroad between <br />the minesite gate and south through PLM lands to the irrigation canal <br />and the paved road. This road status should be researched during the <br />reclamation plan review to determine the reclamation/maintenance <br />obligations of all parties. <br />
