• • <br />I <br />Costilla County Gravel Pit Information <br />page 2 <br />The county was found to be in violation for operating at the <br />unpermitted site (Sierra Grande) near Ft. Garland. The county was <br />to obtain a permit for this site by submitting an application to <br />the Division. The application was to have been submitted by <br />December 19, 1994. The Board Order issued with the Notice of <br />Violation was not amended or lifted, but the county was still given <br />more time to prepare the application. To-date, nothing has been <br />received from the county. Enclosed with this letter are copies of <br />the original Notice and the later "reason to believe" letter issued <br />as a result of the county's inaction. <br />Finally, stemming from concern over the numerous problems the <br />county has with their permits and sites, the MLRB requested that <br />Costilla County prepare and present to the Board a proposal <br />outlining how each of the various problems would be addressed, to <br />bring all sites into compliance with the laws, the permits and <br />Board Orders. This proposal is to be discussed at the June 21-22, <br />1995 Board meeting. <br />In summary, the MLRB understands that some delays are a natural <br />consequence of the county's recent trouble with "turnover" of <br />personnel involved with the gravel pits, and has allowed Costilla <br />County additional time to resolve the identified problems and <br />violations. But the county has largely not performed the required <br />corrective actions or satisfied the Board Orders.
