Long; <br />at pivnion Dueaa <br />This letter, and the enclosed supporting documentation, is to <br />explain a number of problems at Costilla County's gravel mining <br />sites. The problems and violations were identified during <br />inspections of these sites, by staff of this agency. The required <br />corrective actions were to be completed on or before certain dates. <br />Many of the corrective actions have either not been completed or <br />only overdue, paitial attempts to complete them were made. <br />There are four sites in question, all operated by or involving <br />Costilla County. Two of the sites have permits issued by this <br />agency (pursuant to CRS 34-32-101, et sea.). A third site was found <br />to be operated by the county without a permit, for which the Mined <br />Land Reclamation Board (MLRB) found Costilla County in violation. <br />A fourth site, for which a permit application was begun in 1977 but <br />not completed, still exists as a "file" only, because no permit was <br />issued. Following are the permit numbers, site names and <br />locations: <br />Costilla Pit #1 (permitted, near Los Fuertes) <br />~~..~,.. - - ,t Costilla (permitted, near Ft. Garland landfill) <br />M-94-103 Sierra Grande Site (unpermitted, near Ft. Garland) <br />M-77-502 (no name, not active, unpermitted, near San Acacio) <br />At the two permitted sites mentioned above, there were various <br />problems found during monitoring inspections. Some of these have <br />been corrected. Other problems which should have been addressed <br />already, due either to their requiring significant time to remedy, <br />or which remedying would prevent more serious problems, have not <br />been corrected to-date. Due to the inaction on the part of the <br />permittee (Costilla County) at the site near Los Fuertes, several <br />letters stating that said inaction constitutes a "reason to believe <br />a violation exists" have been sent by this Division. Problems at <br />the landfill site must be corrected soon, or similar letters will <br />be sent to the county for that site also. Copies of the letters <br />sent are enclosed with this letter. <br />
