• July 20, 1998
Page 3
RE: Tatum complaint
investigation of out complaints against Basin Resources in a non-bias manner confirms
that the State and OSM protect only those with money and power, not the individual.
During our civil trial against Basin Resources, Inc., it was discovered that $asin
Resources Inc. had conducted a survey of our property that confirmed subsidence had
occurred. Basin Resources, Inc. hid this survey from us until the trial. Did Basin also
hide these facts from DMG and OSM? No, these results were provided to DMG during
the normal course and scope of the federal reporting requirements. Why then did DMG
deny we were suffering from coal mine subsidence? Why did OSM affirm the State's
finding that no subsidence damage existed on our property?
The appeal we filed with the Land Boazd in December, 1995, is still pending. I
am enclosing a copy of my recent letter to Bruce Babbitt as well as my request for
information for certain records to the FOIA officer.
I invite any of the addressees herein to respond to my inquiries, observations
and/or thoughts. Once upon a time, local, state and federal representatives fought for the
rights of the individual. Now we see the soles of their shoes right before they extinguish
the citizen's rights in favorofbig business.
Very truly yours,
Ann Tatum
AT/ah
Enclosures
Cc: Citizens Coal Council
