July 20, 1998 <br />` Page 2 <br />RE: Tatum complaint <br />discusses our lawsuit against Basin Resources, Inc. Naturally, I am ecstatic to relate the <br />issues in our case, the abuses we endured and, what we aze doing to keep our complaint <br />alive. <br />Those with inquiring minds relate that they have difficulty believing that the <br />Government, (OSM) would allow testimony by a govenurtental employee in a citizen's <br />civil matter. I assured them this was in fact the case. I confirm that Michael Rosenthal's <br />testimony was as related in REPORTER, that he had been party to many, many citizen's <br />complaint and had NEVER ruled for the citizen. <br />Reference by the "REPORTER" to the computer software is in actuality the <br />Surface Deformation Prediction System (SDPS). I have been told that while OSM <br />realizes that their application of the SDPS program, with regazd to land west of the <br />Mississippi is incorrect, they (OSM), refuse to administer the softwaze program as <br />intended by the developers of the SDPS software. OSM and their experts categorically <br />deny that OSM misapplies the program when calculating subsidence damage in the west. <br />These deliberate misapplications of the SDPS contribute to the OSM's affirmations of <br />rulings by the various states that subsidence, resulting to coal mining does not occur. Dr. <br />Jesse Craft, the OSM EXPERT, and other various federal employees are subverting the <br />truth. Dr. Jesse Craft may have excellent credentials, but he lacks integrity, honesty, and <br />courage to "do the right thing". I challenge the OSM to famish me all findings of <br />subsidence investigations west of the Mississippi, the computer soflwaze used, the <br />calculations utilized as mandated by the speciftc softwaze, and their findings. <br />By what pretense does OSM operate that they can mislead, misrepresent, abuse, <br />and contribute to the destruction of citizen's property by the coal industry? This is the <br />same moronic thought process that is presently destroying the homes of the Navajo <br />Indians. It has been reported to me that an individual within the Deparhnent of the <br />Interior recently told a member of CCC that the Navajo's should not be protected by <br />SMCRA because they really aren't citizens. Is this an example of the conduct and/or <br />behavior that earned Michael Rosenthal and Billie Clazk recognition equaling $20,000.00 <br />since 1992? <br />The failure of the State of Colorado to enforce the reporting requirements of coal <br />mines pursuant to the federal regulation cost me time, money, and continuing property <br />damage.
