DRMS contradicts the requested amount in the language contained in <br />their first paragraph, "to include the subsidence damage compensation amount specified <br />in the I.as Animas County District Court Case Number O1CV26: ' <br />Un February 15, 2007 DBMS advised OSM that 17RMS's regulations were <br />consistent with 30 CFR 817.121 (c) (5). On Mazch 8, 2007 OSM stated,... "Colorado <br />shall require the permittee to obtain additional performance bond consistent with 30 CFR <br />817,121. {c) (5). On this basis, we have determined that existing provisions of the <br />Colorado program are consistent with 30 CFR $17.121. (c) (5).
