1985. The test program as submitted was accepted by the Division. The petmit language <br />can be found on page 88 of the permit application. <br />Stipulation No. 6 <br />THE APPLICANT SHALL SUBMIT REVEGETATION SUCCESS STANDARDS IN ACCORDANCE <br />WITH RULE 4.15.10 FOR THE PORTAL AREA WITHIN 90 DAYS OF PERMIT ISSUANCE. AS <br />A MINIMUM, GROUND COVER OF LIVING PLANTS SHALL NOT BE LESS THAN CAN BE <br />SUPPORTED BY THE BEST AVAILABLE TOPSOIL, AND SHALL NOT BE LESS THAN THE <br />GROUND COVER EXISTING BEFORE REDiSTURBANCE AND SHALL BE ADEQUATE TO <br />CONTROL EROSION. <br />Status: Terminated <br />Twin Pines agreed to the performance standards set forth in this stipulation in a letter to the <br />Division dated May 23, 1985. Page 88a was revised during the 1989-90 permit renewal <br />process to satisfy this stipulation fully. Page 88a was updated in March 1993 with the <br />approval of Technical Revision No. 5, approved December 28, 1993. <br />Stipulation No. 7 <br />THE OPERATOR SHALL CONSTRUCT A SEDIMENT TRAP (3 FEET DEEP AND 10 FEET LONG) <br />AT THE INLET OF THE LEWIS GULCH FILL CULVERT PRIOR TO COMPLETION OF THE FILL. <br />Status: Terminated <br />Twin Pines agreed to this in a Stipulation Resolution Summary dated November 6, 1984. No <br />further response is necessary. <br />Stipulation No. 8 <br />PRIOR TO UTILIZATION OF THE UNDERGROUND DEVELOPMENT WASTE DISPOSAL AREA, <br />THE APPLICANT MUST PROVIDE MASS BALANCE CALCULATIONS WHICH DEMONSTRATE <br />THE MOVEMENT OF MATERIAL TO COVER THE WASTE DISPOSAL AREA WITH TWO FEET OF <br />NON-TOXIC, NON-COMBUSTIBLE SUITABLE PLANT GROWTH MEDIUM IN ACCORDANCE <br />WITH RULE 4.11.4(2). AS A CONSEQUENCE, THE POST-MINING TOPOGRAPHIC MAP MUST <br />ALSO BE REVISED TO REFLECT THESE CHANGES PRIOR TO UTILIZATION OF THE WASTE <br />DISPOSAL AREA. <br />Status: Terminated <br />This stipulation was satisfied by Twin Pines Investment in the Stipulation Resolution <br />Summary dated November 6, 1984 to the Division. The letter was accepted by the Division <br />on January 28, 1985. <br />Stipulation No. 9 <br />PRIOR TO PRODUCING COAL FROM THE TWIN PINES NO. 2 MINE, TWIN PINES COAL <br />COMPANY MUST RECEIVE APPROVAL FROM THE DIVISION FOR THE RECLAMATION PLAN <br />FOR THE TWIN PINES NO. 1 PORTAL AREA.
