<br />Section II - Revisions to the Permit <br />Since permit issuance, the Division has approved one minor revision and three <br />technical revisions to the permit. These minor and technical revisions are listed <br />below in chronological order. <br />Minor Revision No. 1 was approved by the Division January 30, 1989. The <br />revision allowed for temporary storage of coal and underground development <br />waste on the mine bench. The approval specified that provision for adequate <br />coal storage and underground development waste disposal areas would need to be <br />made prior to resumption of active status, and further specified that adequate <br />berms would need to be maintained to prevent Spillaq_e or drainage of <br />stockpiled material over the bench outslope. <br />Technical Revision No. 1 was approved by the Division on November 28, 1988. <br />The revision terminated the requirement for quarterly upstream and downstream <br />surface water monitoring on the Hay Gulch Drainage due to the lack of <br />potential for impacts to occur as a result of the operation, given the limited <br />disturbance area and the distance from the mine to the stream. <br />Technical Revision No. 2 was approved by the Division on November 28, 1988. <br />This revision deleted the requirement for certain undisturbed diversion ditch <br />segments, specifically the lower segment of the west side ditch and the upper <br />segment of the east side ditch, both of which would have required disturbance <br />to very steep, heavily vegetated undisturbed slopes. <br />Technical Revision No. 3 was approved by the Division on September 27, 1989. <br />This revision was required by the Division to address a number of concerns <br />with drainage and sediment control at the site. Two stipulations were <br />attached to the approval, as listed below. <br />Stipulation No. 1 <br />By October 31, 1989, 3 copies of a revised Map No. 2 will be submitted to the <br />Division, with all road drainage ditches clearly depicted and labeled. The <br />location of Ditch No. 4 will be accurately portrayed and the small area <br />exemption area along with additional Straw Bale Check Dam locations will be <br />identified on the map. Three additional, properly certified copies of Map <br />No. 1 will also be submitted to the Division by October 31, 1989. <br />Stipulation No. 2 <br />All grading, ditching, berming, culverting, and associated drainage control <br />work associated with Technical Revision No. 3 will be completed in compliance <br />with the approved plan by October 31, 1969. <br />Stipulation No. 1 was satisfied by submittal of the required maps on <br />October 16, and 18, 1989. <br />Stipulation No. 2 has not been satisfactorily implemented, and as a result, <br />the Division issued NOV C-89-035 on December 19, 1989. <br />-2- <br />
